Housemate Rental Agreement and Security Deposit Receipt This agreement is made this _______ day of _______________________, between ____________________________ hereinafter designated "tenant", and _____________________ hereinafter designated "landlord". Landlord does hereby rent the ______________________________room(s) of 1210 NE 124th St. Seattle WA 98125 to tenant upon the following terms and conditions: The terms shall commence on _______________________ and shall continue from month to month. This rental agreement can be terminated by either party with or without cause at any time by written notice given 30 days in advance. Tenant agrees to pay _________ rent on the _________ day of each month by personal check, cash, or money order. In the event of a refused personal check, a penalty of $30 will be due in addition to all bank-levied fees and personal checks will no longer be acceptable as payment. Security deposit in the amount of ______________ will be due on the commencement date. Security deposit shall be deposited in landlord's savings account and accrue interest for tenant at the rate thereof. Landlord may use therefrom such amounts as are reasonably necessary to remedy tenant's default in payment of rent, to repair damages caused by the tenant or tenant's invitees, and to clean the premises if necessary on termination of tenancy. If used toward rent or damages during the term of tenancy, the tenant agrees to reinstate the total security deposit within five days of written notice. Security deposit plus interest, or balance thereof if any, together with an itemized accounting shall be mailed to the tenant within 14 days of surrender of the premises. Rent shall be considered late if not paid before 4 days after its due date. Late rent payment shall be subject to a penalty of $25 per portion of each month late per payment. Eviction may proceed if rent is not paid for twenty days. No improvements, modifications, or alterations shall be made without written consent of the landlord. Built-in additions or modifications become property of the landlord upon termination of this agreement. Any unlawful activity, possession or use of illegal drugs, or possession or storage of firearms on the premises shall be grounds for immediate eviction. Smoking is not allowed on the premises. Loose dogs will not be tolerated. Landlord operates a business on the premises, which is a fellow tenant on the premises. Tenant shall treat proprietary information of landlord, this business, and other tenants as confidential, which duty shall survive the termination in other respects of this agreement. p 1/3 Landlord will respect the tenant's privacy, subject to the right to inspect the tenant's room with 24 hours notice, or in case of emergency, suspicion of illegal activity, or tenants' absence while noise or music is coming from tenant's room. Residents are entitled to the quiet enjoyment of their dwelling, and the neighbors are entitled to the same. Tenant will desist and refrain from making loud or bothersome noises and disturbances, will keep down the volume of their music, noise, and broadcast programs at all times so as not to disturb other peoples' peace and quiet. Quiet hours are to be observed by all residents between the hours of 11:00 pm and 7:30 am daily and during quiet hours tenant shall not allow noise, music, or broadcast programs to drift across the hallways or to other rooms and areas of the house, nor shall tenants operate loud or bothersome or noisy appliances such as vacuum cleaners, laundry washers or dryers during the quiet hours. If tenant wishes to have a loud party, permission must be granted by the other residents of the house. Garbage should not be left in paper bags on the floor where it may stain. Crankcase or other oil must be disposed of properly. Each pets must be pre-approved by landlord; additional rules regarding pets may be established from time to time by landlord; each approved pet requires a pet deposit of $150 excepting fish, applicable to damages attributable to such pet or pets. Tenant shall not abandon unsightly litter, clutter, car repair equipment, or the like in common or outside areas. When tenant leaves the rented facilities should be in the same condition when he/she arrived, subject to normal wear and tear. Tenant shall keep the furniture and fixtures in good order and repair and pay for repairs caused by tenant or tenant's invitees. The tenant's personal property is not insured by the landlord. Landlord encourages tenant to purchase renter's insurance and tenant acknowledges having received such encouragement. Tenant shall not let or sublet tenant's facilities or transfer this agreement. Each rental bedroom shall be occupied by one person only, that person being the tenant. Except for casual guests, no other person shall occupy the rented premises or otherwise live here even temporarily. Tenant may house any single guest within the tenant's bedroom for a maximum period of twelve days every six months or for whatever period of time the law allows, provided that the guest shall maintain a separate residence elsewhere. Tenant shall be responsible for the behavior and demeanor of their guests and for any extra expenses they may incur upon the premises and the household. Tenant shall not alter the property without landlord's prior written consent. p2/3 If absent without explanation for two weeks while rent remains unpaid then the premises will be considered abandoned. If the tenant abandons or vacates the premises the landlord at his option may terminate this agreement and regain possession as prescribed by law. Cost of utilities shall be split equally among the housemates, but if the tenant uses an excessive amount of water, electricity, etc., then the utility costs will be renegotiated. If any legal action or proceeding is brought by either party to enforce any part of this agreement, the prevailing party shall be entitled to, in addition to all other relief, reasonable attorney's fees and costs. Time is of the essence. Waiver by either party of any breach shall not be construed to be a continuing waiver of any subsequent breach. Nothing contained in this agreement shall be construed as waiving any of the landlord's rights under the laws of the state of Washington. If any term of this agreement is invalid or unenforceable, the remaining terms shall be interpreted so as to reflect the intentions of the parties hereto.
